Successor Trustee During Lifetime

We provide Successor Trustee services to individuals during a time of disability or incapacity. Under any instance that we are named as a Successor Trustee, we require that we also be named as the individual’s Successor Agent under a Power of Attorney.

Successor Trustee Upon Death

We provide Successor Trustee and Administration services to individuals upon death and married couples upon the death of the surviving spouse. Under any instance that we are named as a Successor Trustee, we require that we also be named as the individual’s Personal Representative under the Pour-Over Will.

Personal Representative Under a Probate

When an individual dies without a trust, the assets of the individual’s estate will be subject to a probate. The individual may nominate a Personal Representative within a Last Will and Testament. Alternatively, the Probate Court may elect to appoint a Personal Representative on the decedent’s behalf.

We are available to serve as Personal Representative under a Last Will and Testament or pursuant to a court appointment.

Trustee for Trusts of Long Duration

There are many types of trusts that are created with the intent to exist for a period of a long duration. Such trusts include:

  • Irrevocable Life Insurance Trusts
  • Spousal Limited Access Trusts
  • Intentionally Defective Grantor Trusts
  • Lifetime Protected Beneficiary Trusts 
  • Special Needs Trusts
  • Life Estate Trusts
  • Qualified Domestic Trusts
  • Dynasty Trusts

Typically, these types of trusts have a built in requirement for appointment of an independent fiduciary, who is not related or subordinate to the Trustmaker or Beneficiaries, to serve as Trustee or Co-Trustee.

We are available to serve as an initial Trustee or Successor Trustee.

Trust Protector Services

A Trust Protector (TP) is used within irrevocable trusts. Generally, a TP’s primary duty is to safeguard a Trustmaker’s original intent and safeguard the interest of the trust’s beneficiaries; though, the responsibilities entrusted to the TP vary by trust.

We are available to serve as an initial TP or successor TP.

Private Trust Company Support

Private Trust Companies (PTCs) have become increasingly popular amongst high-net worth individuals and families. The individuals or families who choose to create the PTC can select the officers and committee members.

We are available to serve as an officer or committee member.
